2023 Contract for Purchase of Standard Poodle Puppy

This contract is between Debra Sterns of Callasterns Standard Poodles (Seller) and _______________________________________  (Buyer/s).

 Buyer is purchasing a standard poodle puppy for the amount of $3500 for AKC Limited Registration on a spay/neuter contract. Special Treaty is available for Open Registration, with price to be determined along with special addendums to include mandatory co-ownership.

Upon confirmation of pregnancy via ultra-sound the completed Pre-Purchase Puppy Questionnaire will need to be on file with me to put you on the waiting list. After birth, a non-refundable deposit of $500 and two (2) copies of signed, notarized Contract for Purchase and the Pre-Purchase Questionnaire will be required to reserve a puppy. This deposit will be applied toward the purchase price. If, after entering a Contract To Purchase, you change your mind, for any reason, the deposit is forfeit.

Payment in full must be made and bank cleared 10 days prior to picking up the puppy if paying by check/money order; payment in cash or via ZELLE is accepted the day of pick up. No PayPal payments will be accepted. Puppies will not leave prior to 10 weeks of age. If you cannot pick your puppy up at 10 weeks of age, I can hold the puppy for you. The per diem fee is $25 per day and if it is past the 30 day window on the health certificate - another health certificate must be prepared. That cost is office visit plus $50 for the certificate and, if it is time, the next series in the puppy shots will need to be given. Puppy must meet weight requirements to fly in cabin - not more than 20 pounds. Please make checks/money orders payable to Debra Sterns, thank you. Payment of additional fees will be accepted when you pick up the puppy.

 Before you pick up your puppy, the two notarized copies of the Contract to Purchase must be fully executed and on file with me so that I may have my signature notarized before you arrive. Your original copy will be included in your puppy folder and I will retain the second original in my files.

Puppy has a current Health Certificate, has been wormed, Microchipped and received his/her first in a series of 3 core puppy shots. Tails were docked to PCA breed standards and dew claws were removed. It is recommended that until 3 weeks past the date of the 3rd of the puppy shots series is complete, the puppy should not be taken into public areas visited by other dogs (i.e. no dog training facilities, dog boarding facilities, PetSmart, Groomer, etc.) for their safety or have outside dogs visit in your home. Puppy is NOT to receive the rabies vaccine with the last puppy shots. Rabies should always be given at least 2 months later and without any other vaccine. You’ll have to insist on this with your Vet. Unless your puppy will be running in the woods it does not need a Leptosporisis shot, however if that is what you plan with your pup, please consider getting the Rattlesnake Vaccination. Do not use topical flea/tick medicines. There are natural/organic products that will do the job without the chemicals.

The second series of shots is due at 12 weeks old, the final at 16 weeks old. Do not allow any "extra" vaccinations - this is simply for the distemper/flu/parvo shot. Again, Rabies shots must not be given with any other vaccinations. You must wait at least 2 weeks after the last puppy vaccination but not until a minimum of 5 months of age. I strongly encourage the Dr. Dodds Limited Vaccine Protocol with all puppies and dogs. Although there can be no absolute guarantees of long-term health, the thorough testing of both Dam and Sire for any adverse genetic disease/structural abnormalities has been completed and the results are published through OFA. You will be given a copy in your folder.   There is a slight chance of color banding on teeth that will not be visible until the permanent teeth come in.  This does not affect health of the teeth or the puppy. It is not damaged enamel - just lightly stained/colored. It does not deter you from showing the dog in AKC or UKC Conformation classes.  PCA does not consider this a fault.

It is a requirement that you take your new puppy to your own Vet for a thorough Wellness Physical Exam/introduction to your Vet within the first week you have him. That first appointment MUST NOT include any vaccinations or worming. All vaccinations are up to date and puppy received worming on the date of the issuance of the Health Certificate.  You will have a copy of the office notes for the puppy to share with your vet. If you are unhappy with the results of said exam, I will have him examined again by my vet, or if you are not local, a vet of my choice in your area, recommended by my Veterinarian. If the result is the same, I will take the puppy back and refund the purchase price less transportation, board and non-refundable deposit after the puppy is re-sold. There is no option to keep the puppy and receive a partial refund.

Unless your puppy is to be an AKC Conformation Show or AKC Performance Prospect, or will have full breeding rights, which require open registration, your puppy is being sold on an AKC Limited (Spay/Neuter) Contract. Proof of spay/neuter must be provided to Seller by your Vet. You are required to wait until a minimum of 24 months to spay or neuter this puppy. This requirement is based upon all the new Vetrinary information available on its’ affects on structural growth and overall long term health. New research has shown significant disruption in structural integrity by spaying/neutering too young.

A preventative gastroplexy at the time of spay/neuter is strongly advised as these are deep chested dogs and, historically, bloat is a concern in all dogs built this way. Although bloat is not noted in my breeding line, there are reasons beyond genetics for a bloat to occur. The gastroplexy will keep the stomach from twisting and cutting off the blood supply (torsion) and possibly be the difference between life and death of the pup.  It is strongly advised that all puppies should be covered by medical insurance.  Most accidents happen within the first 2 years.  My own recommendations are Embrace Pet Insurance and Pet’s Best Insurance. Purchasing insurance early removes the chance of any pre-existing stipulations and costs less. If you decide on Embrace, please ask immediately for the orthopedic waiver when you bind your policy and have them e-mail it to you. Please have it available for your first vet visit, have it signed by your Vet and send a copy to Embrace - otherwise there is a 6-month waiting period for orthopedic coverage. The Orthopedic report card cuts that waiting period significantly.

You will activate the Microchip Registration before you leave my home with the puppy. My name is to remain on the chip as an alternate contact for the life of the puppy.  I am to be immediately notified of loss, death or disability of this puppy and the circumstances. If you relocate in the future, you must update your information with me and the microchip company. This is for the protection of the puppy and your peace of mind. You will also fill out the AKC registration papers so be thinking of a name or pick one I’ve chosen! The Kennel name “CALLASTERNS” is to be used as the first word of the registered name. We will use the online registration process.

Your puppy folder will contain the Dam and Sire’s AKC registration information, photos of Dam and Sire, a copy of the Litter Registration (which includes a 3-generation pedigree), the puppy's individual AKC Registration Form, the Microchip Registration form with tag and additional bar codes of the chip info, copies of OFA health statistics for both Dam and Sire, the puppy’s current health certificate, a copy of my Vetrinary office notes to give to your Vet of choice, information on the Bio-Sensor Stimulation (to which I add Scent Work), and Puppy Culture socialization are available on my FAQ sheet dealing with everything puppy/poodle related that I can help with.

I will take and share photos and videos of the puppies on my Debra Callahan Sterns Facebook page throughout your puppy’s development. If you are not on Facebook, I will send yours to you individually. You can watch him/her grow and develop before he/she comes home with you. I will always be available and happy to answer any questions you may have about this puppy. If you have questions I can't answer - I will strive to find the answer for you!!

Initial puppy selection is at my discretion based on your wants and needs but, ultimately, the puppy’s choice is final. Pick of the litter for show quality (either sex/color) remains with the Seller and cannot be determined until 9 weeks of age. In case of conflict, choice remains with Seller to retain that puppy or allow the puppy to go to the buyer. When final pick has been made, I will begin to call your puppy by it's new call name, provided by you.  A “call name” does not have to reflect the AKC Registered name.        

No visitors are allowed until the puppies are a minimum of 3 weeks of age and we use precautions before you see the puppies, for their protection.  No shoes in the home and use of sanitizer on hands and forearms. Visitors must have a signed contract and deposit on file to visit puppies or be invited by me to be part of the Puppy Culture socialization process.

I do not ship my puppies. If you are traveling by air or have a long car drive, I will provide Nutri-Cal paste to keep your puppy's blood sugar stable during travel and a few disposable pee pads. Flight Health certificates are only good for 30 days and there is a 20 pound weight limit for in-flight carriers.  I do have a soft crate that I will loan to you for your flight or trip. It is to be returned, clean, as soon as you are able.

I retain first right of refusal if, at any time, you become unable to keep your puppy, to have the puppy returned to me at Buyer’s expense. Please provide the name, address and phone number of the person you have designated as guardian of the puppy in the event of an incapacitating illness or death. The person taking over the temporary care of the puppy/dog will need to have my contact information and I will need their’s in order to discuss the return of the puppy to me or their continued ownership of said puppy, at my sole discretion. They would then be required to complete a notarized contract with me under the same terms you have in place. Puppy will NOT be sold or given to another party, family member, or rescue organization without my notarized, written approval unless approved prior to purchase. Puppy will NOT be turned over to any Public or Private Animal Shelter/Breed Rescue or legal remedies will be sought. If the puppy is returning to me, the AKC Registration papers will be signed and transferred to me, as well as clearing the microchip and assigning the number back to me via email to the company with a copy to me. All stipulations within this contract migrate with the puppy to the receiving party, whether temporary or permanent, at my discretion. Failure to follow these stipulations will be enforced, legally, with Buyer or any un-authorized Recipient of Puppy incurring all legal costs, per-diem, Vet and transportation fees as well as retrieval, if pup was adopted.

If it comes to my attention, at any time, that the puppy is being abused physically or mentally, being used for breeding without my approval and revised contract, or housed inappropriately, I will arrange to retrieve the puppy and be provided immediately with all relevant paperwork (AKC Registration with appropriately signed transfer and Microchip release) with puppy folder provided to you and will re-sell/re-home the puppy. If legal action has to be taken to retrieve the puppy, Buyer will be responsible for all of Seller's legal fees, Transportation, Per Diem ($175 per day) and Court Costs, including special fees associated with the serving of papers. If the puppy has been used to produce doodle or merle puppies, whether by actual birth or by stud service, contract is in default and puppy will be returned to me at your expense and a punitive payment of $5,000 per puppy produced will be due and payable to me; any stored frozen semen, if male, that was collected, will also be signed over to me with pertinent information provided on the vet/storage unit. You will notify such Vet or storage facility of the transfer of all held semen by that male from you to me. I will receive a Release of Ownership of such Semen via notarized letter. A full accounting for the storage of semen will be required to insure that no breedings were shipped to another breeder for use without authorization. Owner will provide shipping of referenced semen to a facility of my choice. No refund will be forthcoming in that event.  Enforcement by legal remedy will incur additional court costs to puppy owner.  There will be no Co-Owners on puppies I have bred, other than your spouse/parter and me, without prior approval. Co-owners must also execute their own copy of our questionnaire/contract and have 2 copies notarized for me.  

Contract entered into this ____ day of ______________, 2023. No alterations will be made to this contract without prior approval and initials from all parties to this Contract. Notary Jurat/Affidavit must be attached to both copies of contract.
